C l a u s e s

First.- The leaseholder is obliged to use the vessel as if it was his own property, according to the rules of good Seamanship and will respect the relevant Marine Authorities. The leaseholder is further obliged that the vessel and all her installations shall be kept in a good condition.

The leaseholder will have on board at any one time the permitted number of passengers. The vessel shall not be used for commercial gain only for private and pleasure use.

The leaseholder cannot participate in any regattas or racing competitions. The vessel's navigational limits will be within Spanish Jurisdiction.

The leaseholder shall not leave the vessel unattended whilst moored or anchored in bays or unprotected waters.

The leaseholder shall not use the vessel whilst under the influence of alcohol, drugs (legal or illegal) or load illegal substances.

The leaseholder is responsible for any damage caused on the vessel or the loss of any of its equipment (unless the loss was caused by Third Party), as well as any delays incurred whilst returning the vessel.

Second.- In case any member of the crew or he himself suffers an accident whilst on board, the leaseholder shall inform the leasing company. An written accident report form shall be completed explaining the causes, circumstances and the consequences of the incident during the following 48 hours. All names and addresses shall be taken (if known) of any guilty party; the same applies to any witnesses or victims if there were any. An accident is to be understood within this contract as to be a spontaneous, exterior, violent incident which has not been caused deliberately.

Third.- In case of litigation both parties expressly renounce their own jurisdiction, if any and submit themselves to the superior Courts of Denia.

Forth.- As proof of their agreement, once read and agreed by both parties, they comfirm and ratify the contents, by signing this contract in duplicate and to the same effect, in the city and date indicated at the head of the contract.

Fifth.- The prices include: Complete equipment according to the description of the boat. The yacht will be handed over with full tanks and shall be returned in the same manner. If this is not the case, the cost of the fuel used will be paid. Vat and insurance are included.

Not included: Catering, fuel, mooring in Denia after check-in or in any other marinas nor any other item that has not been stated aforehand. Cost for cleaning has to be paid if the boat is used over night or for any other charter period (not including cleaning of kitchen equipment).

Deposit: Guarantee deposit (paid in cash or by credit-card). The deposit (once the amounts for fuel consumption, breakages, losses of equipment, etc. Have been deducted) will be returned on finalization of the charter. If the boat is chartered with a Skipper from our Company, the deposit will only be 50 % of the amount shown above.

Skipper: Should a Skipper be required, there is an additional cost per day + meals.

Check in / check out: Checking in on daily charters from 10.00 hours. Check out between 18.00 and 19.00 hours. Late returns to the port of departure will carry a penalty of €60 per hour plus vat.

Insurance: All our yachts have the necessary legal documentation and are insured at full risk.

Bookings: a reservation is considered as provisional until we have not received the 30 % of the total price on our bank account.

Conditions of payment: 30 % on confirmation of the booking and signature of the contract. The remaining 70 %, 30 days before the check-in into our account.

In case of a short time booking, in cash/credit Card before check in.

Cancellation: the cost of the cancellation of a booking is 30 % of the total charter price, if the cancellation is produced 60 or more days before check in, 70 % between 60 and 30 days before check in and 100 % if the cancellation is produced within 30 days before check in.

Permits: The client holds the necessary navigation permit to charter the boat without a Skipper, and can produce the original of said permit, together with all supporting documents where required.
